Description
Order Before: MERRITT and JONES, Circuit Judges; WISEMAN, District Judge* This is a patent infringement case. District Judge, John Feikens, held that plaintiff's patent was an obvious extension of previously existing patents and was thus invalid under 35 U.S.C. § 103 (1976).We affirm. Plaintiff, Britax, Ltd., of London is the assignee of patent No. 3,237,729, granted to Ronald A. Proctor on March 1, 1966. The Proctor patent involves a seat-belt locking system that is activated by accelerations or decelerations of a specified level. This system allows unrestricted movement of the wearer provided there is no sharp or sudden force on the belt or harness.
